Agreement between The Association of Billiards Professionals and Barry
Behrman, regarding the US Open Nine Ball Tournament of 2011
Barry Behrman and Shannon Paschall, individually and on behalf of the US Open Nine Ball Tournament. (The parties of the first part) agree as follows:
1. The parties of the first part shall open an Escrow Account forthwith for the prize fund of the US Open Nine Ball Tournament of 2011 (Toumament) which account shall only have Rob Johnson and Ivan Lee of the Billiard Congress of America (BCA) authorized to sign checks or make withdrawals.
2. Beginning with an announcement today, the parties of the first part shall direct all
players to send their entry fees for the Tournament directly to the BCA to be deposited
in said Escrow Account.
3. On or before September 20, 2011 the added Prize fund monies of $50,000 will be
deposited by the parties of the first part into the BCA escrow account.
4. Based upon a full field of 256 players, the total prize fund wilI be $178,000 and the
top 96 players will be paid. Of that prize fund, Places 65-96 will be paid in cash by the
parties of the first part and those funds will not be taken out of the BCA escrow account.
5. The monies for all entry fees that are paid in cash the week of the tournament shall be collected jointly by Johnny Archer or Rodney Morns and Barry Behrman and/or
Shannon Paschall and shall be accounted for and deposited into the BCA Escrow
Account on the next business day.
6. The parties of the first part agree to make deposits into the BCA escrow account to
bring the balance up to the amount required to pay the top 64 places or a net amount of $162,000.00 by Wednesday, October 19, 2011. The parties of the first part will make daily deposits from the gate and from other sources starting the first day of the Event until all necessary prize funds are in the account but in no event later than October 19, 2011.
7. The BCA will write the checks for the top 64 finishers in the event for a total of
$162,000 out of the BCA Escrow Account that will have been funded by the parties
of the first part.
The Association of Billiards Professionals (the party of the second part) agrees as follows:
1. They will communicate to all their members and to the pool industry in general that the boycott of the US Open Nine Ball Tournament has been lifted. They will encourage
all members to attend said tournament.
2. They will agree to participate in a Pro-Am Tournament on the Friday before the US Open to help promote the event.
